Good news: the total number of trademark filings in China is slowing down (Eligon insight: we see this as a positive trend!). However, there’s a clear rise in complicated trademark cases.
The graph below illustrates the steady increase in complex cases filed with China’s Trademark Appeal Board (TRAB) from 2018 to 2023. While fewer trademarks are being filed overall, the cases that do reach dispute are becoming more challenging and nuanced.

What’s driving this? One big factor is the courts’ growing willingness to award high damages—even by U.S. standards—and punitive damages. This shift not only deters bad-faith filers but also makes it worthwhile for brand owners to defend their trademarks in court.
