Reminder for Trademark Owners: 2025 USPTO Proposed Fee Increases

With the end of the year approaching, Eligon encourages trademark owners to consider completing any pending filings in 2024 to save on costs. While the exact fee changes are not yet finalized, the U.S. Patent and Trademark Office (“USPTO”) is expected to implement fee increases in early 2025, affecting fees at all stages of the trademark process, from applications to renewals.

Why File Now?

Filing before year-end allows you to lock in current rates, which could lead to significant savings.

 

Recommendations to Help Minimize Costs

  • File New Applications Before 2025: If you’re planning to file new applications, consider submitting them before year-end. If the mark is not in use, we can file an intent-to-use application.
  • Submit Maintenance Filings: For any required maintenance filings to confirm your trademark is still in use, aim to file before year-end to lock in current fees.
  • Submitting Proof of Use for Intent-to-Use Applications: For intent-to-use applications, filing your Amendment to Allege Use or Statement of Use by the end of 2024, if possible, will help you avoid higher fees in the new year.
