About
Chad has served as primary outside intellectual property counsel to companies ranging from garage start-ups to Fortune 500 corporations, as well as governmental entities. He understands that one size most definitely does not fit all, and clients find that he provides value by tailoring each client’s intellectual property strategy to ensure that the investment is reasonable in light of that client’s business situation, and to optimize value, rather than merely the size of the client’s portfolio. portfolio.
Chad considers all his clients friends, and he enjoys interacting with them as people, not merely as part of a business or legal transaction. His clients appreciate his ability to relate to many different types of clients, from general counsel who know nothing about technology and little about intellectual property to hard core engineers who find personal interaction difficult. Chad’s goal is to make the attorney-client relationship as comfortable for the client as possible.
Chad’s experience within intellectual property is both broad and deep. Most of his clients look to him for IP prosecution, strategic portfolio management, pre-litigation counseling, and opinion work, as well as strategic advice in the areas of privacy and data protection. He also has extensive experience in adversarial proceedings, including inter partes proceedings before the U.S. Patent and Trademark Office, as well as intellectual property litigation at the trial and appellate levels in both state and federal courts.
When Chad is not practicing law, he enjoys spending time with his family and Bernadoodles. He enjoys living in Colorado and tries to take advantages of the beautiful weather and nearby mountains in all seasons. Chad (usually) enjoys playing golf, and his other hobbies include travel, cooking, reading pulp sci-fi novels, and writing computer software.
Chad is also the owner of King Intellectual Asset Management, a firm that provides custom-tailored intellectual property counseling and litigation. Previously, Chad was an associate and partner at Townsend & Townsend & Crew LLP (n/k/a Kilpatrick Townsend & Stockton LLP for nine years and a partner at Adsero IP LLC (f/k/a/ Swanson & Bratschun LLC) for twelve years. Prior to and during law school, Chad worked as an IT Specialist at IBM Global Services, developing and troubleshooting software and networking solutions.
Highlights
- British Telecomm. v. SBC Communications, et al. (D. Del) – Served as lead counsel for Qwest in a patent suit filed by British Telecom against SBC, Qwest, Verizon, and Level 3. Developed noninfringment theory under 35 U.S.C. § 271(g) and wrote brief supporting motion to dismiss for joint defense group. Motion granted, resulting in a stipulated dismissal.
- Netflix, Inc. et al v. Broadcom Corp. (PTAB) – Represented Broadcom in an IPR filed by Netflix. PTAB denied institution of the IPR.
- Netflix, Inc. et al v. Avago Technologies International Sales Pte. Ltd. – Represented Avago in several IPRs filed by Netflix. PTAB denied institution in three cases, issued Final Written Decision holding all claims valid in three other cases.
